This three-hour, virtual seminar will provide participants with a detailed review of 42 CFR Part 2, and a cursory overview of HIPAA, the HITECH Act, and the CARES Act, with special emphasis paid to differentiating the mandates of 42 CFR to the mandates of these other privacy-related federal statutes.

Objectives
At the end of this workshop, participants will be able to:
Explain what is meant by the statement: “Informed consent discussions must meet the legal tests of being both ‘informed’ and ‘voluntary’ to be considered legally defensible.
Differentiate the concepts of “Duty to Protect”, “Duty to Warn”, and “Mandated Reporting, and provide an example of each as they relate to behavioral health professionals.
Explain how the use of an evidenced-based ethical problem-solving model can assist counselors in resolving confidentiality related ethical dilemmas in a legally defensible manner.
